Terms & Conditions

All Clients should read through ALL of the Terms & Conditions PRIOR to booking and prior to their scheduled shoot as it will help keep you as informed as possible and prepare you for your shoot and what to expect in regards to the business details.  The more you know the more you can relax and focus on enjoying the experience as opposed to worrying about potential surprises on the business end of things!   ANY payments received will serve as a confirmation that you have read and AGREE to ALL terms and conditions.


Definitions:
The Photographer: 
Imari Mitchell & Lamp Productions Photography
The Client:  Any person, body of persons, firm, or Company with whom the Photographer enters into a contract for the sale of goods or provision of services by the Photographer.
Proof:  Samples of all edited photos, in which Lamp Productions Photography (The Photographer) holds all exclusive rights to.  These cannot be saved to Client’s computer, used on social networking sites, or printed, and will contain either Lamp Productions Photography’s logo, watermark, or proof stamp.
 

Deposits & Payments:
A Non-Refundable deposit is due upfront at the time of booking in order to secure your selected date and time.  Your deposit must be paid in full in order for your slot to be secured.  Until your deposit is received, the date and time you requested will remain open and available for any possible client who is inquiring.  The balance on your account is due IN FULL at least 72 hours prior to your scheduled shoot.  Failure to submit your payment in full could result in the release of your time slot and cause you to have to reschedule and require an additional deposit for the rescheduled time.

 

Timing, Cancellations & Rescheduling:
Timing is very important as our photographer often has multiple shoots scheduled in a day.  Your timeliness is than also very important.  You are only given the time that your booking is scheduled for, meaning if you are booked for a 1 hour shoot at 3pm and you don't arrive until 3:20pm that means you only have the remaining 40minutes left in your session, and the photographer is not obilgated to stay past the time that was originally scheduled.  If you do happen to be late and you desire to add more time to your session, as long as the photographers schedule allows for it, you may purchase additional time.  If you are running late (more than 15 minutes) and you need to reschedule for any reason, you may do so, however there will be a last minute rescheduling fee of $50 assessed to your account which must be paid before the start of your newly scheduled session.  If you are more than 45 mins late to your shoot, the photographer reserves the right to cancel your session and you run the risk of forfeiting your entire session fee.  We would recommend that if you know you are going to be that late to a session that you contact us asap to simply reschedule your session so that you don't have to lose out on the money you have already invested.

 

Cancellations must be made at least 48hrs in advance of your session date.  All cancellations made within 48hrs forfeits your entire session fee.  Each client is allowed two rescheduling credits for their session (these must be made at least 24 hours prior to your scheduled shoot).  Any additional request to reschedule will incur a $50 rescheduling fee and must be paid immediately to reserve your new date.  Rescheduling due to weather conditions will not count against your reschedule credits.


Overages & Additional Time:
Each session has a set time included in the package you selected.  Our photographer is very flexible and absolutely willing to work with you, however her time is valuable and in order to ensure she is properly compensated for her time and talent we have provided some options for you should your session run over and you wish to continue the shoot.  Should the photographers schedule allow, Overages are charged by the minute at the prorated amount of your session total.   For example; if your session was $150 for an hour  then you would divide that by 60 minutes and you would be charged $2.50 per additional minute to be paid by cash or card in full at the conclusion of your shoot directly to the photographer. 

Proofs and Additional Images:
We usually take a ton more shots than what is given in the included galleries.  This is very normal for photographers, as we usually continuously shoot during a session to be sure we get all the best stuff for our clients and then we sort through to find what we feel are the best ones which are then delivered to the client in an online gallery.  The amount of images in the gallery varies based on the package that was ordered.  Usually within 2 weeks of your shoot you will get access to an online gallery of all of the edited proofs from your shoot and you will be asked to select the images that you like best (up to the number included in your package)  and a new downloadable gallery of JUST the images you selected will be sent to you.  Should you decide you want a few extras from the proof album, they are available for $4.99 each OR you can purchase the FULL ALBUM for an additional fee determined by the Photographer.  We do NOT offer any unedited originals as we reserve the right to edit and release only the images that we deem creditable as professional in quality and within Lamp Productions Photography’s standards. Most of our clients come by word of mouth after seeing our work in someone’s home or on social media, and we wouldn’t want a photo released that doesn’t represent our work.

 

License:

All images are the property of Lamp Productions Photography and are copyrighted by law. None of them may be copied, used, or published for commercial purposes without Lamp Productions Photography's clear and written permission to do so. Lamp Productions Photography and Imari Mitchell reserve the right to use any and all images on their social media platforms, websites, blogs, or any other related marketing material they deem necessary.

Social Media:
It is understandable that the Client might want to post their new photographs on the Internet via Facebook, Twitter, Tumblr, Instagram, and/or any other social media outlets. This agreement will serve to allow posting photos to your social media sites, ONLY in the case that @LampProductionsPhotography is credited and that the images are NOT altered with any editing or filters.  Additionally, it is understood that the client will NOT remove, or have removed, watermarks from Internet images Lamp Productions Photography has uploaded to social media or her website or in any other way.  The Client and family members can purchase photographs that do not have a watermark.  You are permitted to click the “share” button on any photos posted to Lamp Productions Photography’s Facebook or Instagram pages.  Sharing can NOT be done via screen shots of photos on Social Media, Website or the Proofing gallery.

 

Edits:
Lamp Productions Photography reserves the right to edit and release only the images that are deemed creditable as professional in quality and within Lamp Production's standards. The photographer enhances photos via corrections to contrast, lighting, and color, as well and removal of baby acne, rashes, and accidental last minute scratches, bumps, etc. Lamp Productions Photography does not change any inherent qualities of a person, as it is considered a "cosmetic edit" and will be $20 per photo if it is requested by the client after seeing the edited proofs. Cosmetic edits include, but are not limited to: removing unwanted facial hair, adding hair to balding head, changing hair color, changing shape of nose, eyes, body, etc. It is requested the client take care of all cosmetic changes before the shoot if they do not wish to have gray hair, facial hair, etc in final photos.  Once again, edits are solely made by Lamp Productions Photography, any edits by clients or family members to digital files will void contract and close gallery from future re-openings.
